the fact is that the arbiter made the decision - not management (MLB) or the players union (Players Assn) so his schemin crook lawyers had nothing to do with it. they presented their case ... management was against him, players association was for him, and the arbiter breaks the tie. there's much more that we don't know - for instance both the union and management don't want details of the case or the decision made public and that is pretty damn interesting.

i don't care if he cheated or not or if he plays well or not. if he's guilty, he got away with it. if not, well then he still has problems.

This whole mess should've happened behind the scenes, out of the public eye. ESPN is completely responsible for that. Unfortunately even though his appeal was successful Brauny will always be guilty in a % of the baseball fans eyes. I have to say that if he had been suspended 50 games, I was ready to quit watching baseball again. I just cam back to it after about 4 years of "steroid era" b.s. I'm extremely happy he's back and hope he has another big year.

Ryan won his appeal!
Ryan Braun wins his appeal of positive drug test

A 2-1 decision means that Ryan WILL NOT be suspended. The arbiter who was the tie-breaker cited the chain of custody as the fault. The person who was supposed to send the sample for testing missed the delivery deadline. Instead, they refrigerated it at home and sent it out the next day.

Of course, MLB is not pleased with the decision to throw out the initial drug test and not suspend Ryan. Their statement is in the first article linked. They stand by their testing procedures in this case. I have a feeling that the tie-breaking arbiter won't be working with MLB again anytime soon.

The bigger story in all of this is why this all became public in the first place. Who leaked the story to the media? Why wouldn't ESPN and other outlets who reported the initial failed drug tests cite their sources? They don't necessarily have to name names, but at least say where it came from. (Was it the person who improperly stored the sample? Was it someone at the lab running the tests? Was it someone who works for the appeals board?

Sadly, there are some who still think that Ryan did knowingly take PEDs. It doesn't matter what he does, this will be with him for the rest of his career.

I think I'll reserve judgment until after the appeal process is complete. It will be interesting to see what the outcome is and the aftermath. If Ryan wins his appeal, it could call into question other failed drug tests. For example, Manny Ramirez could point to Ryan's case to show how flawed it is and that he himself shouldn't be suspended for failing a drug test. If Ryan loses his appeal, he will be viewed as a hypocrite and a cheater. Brewers fans might demand that he forfeit his MVP award, but only the BBWAA (who vote on the award) can convene and forcibly strip him of his title. At the very least, he will likely be suspended simply for ignorance. Either he didn't let his doctor know what he couldn't take, or he didn't let his coaches and manager know that he was taking something that could skew a drug test.

This is not correct. Low testosterone does not cause the herpes outbreak. Doctors aren't sure what does cause the outbreak but stress and sickness seem to be two factors. Many outbreaks occur in women during their time of the month when their testosterone is at its lowest but again, doctors have yet to prove cause and effect.

If he was taking a med to fight a disease or treat symptoms of a disease, then he, his doctor, and his agent should have conferred with MLB first. They should have informed MLB if the meds would cause a positive result in a test for a banned substance.

These guys all know about the random tests. MLB isn't going to refuse a guy his necessary medicine. So why not be safe and inform MLB ahead of time.

Because the initial report was leaked before the appeal process began, Ryan has already been judged in the court of public opinion. Even if it is found that he was taking a medication that contained synthetic testosterone, even if his name is cleared and he admits he should have known what was in his meds, he is still going to be seen as a hypocritical cheater and a liar by many baseball fans.

I do think he'll still have to serve the suspension. Maybe not for failing to tell MLB he was taking something containing a banned substance, but certainly for not checking with the doctor or pharmacist that his medications didn't contain any banned substances.

I'm not sure of the exact MLB procedures but I'm pretty sure that they have to list all prescriptions with the team. They're people just like the rest of us. Some of them must be taking 'scripts on a regular basis for cholesterol, depression, ADD, whatever. So maybe it was a prescription that he hadn't listed and it caused the positive test result, and then if that's true, he'll probably have to serve the suspension b/c  he violated the procedure of not reporting the use of the medicine.

The thing that really bothers me is that the initial story was leaked. That just sucks.

So apparently Ryan is taking a prescription medication that contains synthetic testosterone, which is what triggered the positive result in the initial PED test. Nobody is disclosing what sort of medical condition he has that he's taking the prescription for, but it has been speculated about. (I'm not saying what it's rumored to be because it's a private matter and I don't want to risk perpetuating a rumor if it turns out to be false.)

So while it initially sounds like Ryan's clear, he may still have to serve a 50-game suspension.

Brendan Katin, one of Ryan's teammates in his minor-league days had tested positive for PEDs. He appealed and two months later was exonerated. Baseball Nation's story:

Brendan thinks that the false positive may have been the result of him going out for a few drinks the night before. Ryan still maintains his innocence in his case and is awaiting the outcome of his appeal.

There are a lot of safeguards that make a false positive nearly impossible. So, Chances are, he did something he shouldn't. No "Oops, I didn't know I shouldn't have taken that." or anything. There is a list of substances that can cause false positives, but if you take one of those, you don't get the 50 game ban.
