AFL star gets court order on girlfriend By Steve Butcher February 3, 2006 Melbourne Football Club's Colin Sylvia leaves court yesterday with girlfriend Elise Whichello. The player agreed to a magistrate's order not to assault his girlfriend. A MELBOURNE Football Club player has been ordered not to assault his teenage girlfriend after an early-morning incident last weekend. Colin Sylvia, the AFL's No. 3 pick in the 2003 national draft, was yesterday also ordered by a magistrate not to harass, threaten or intimidate her. The club may now be obliged to report the matter to the AFL under the league's new policy that promotes a safe and inclusive environment for women. Sylvia, 20, appeared in Melbourne Magistrates Court yesterday accompanied by his girlfriend, Elise Whichello, after police were called to a road in Albert Park at about 3.30am last Sunday. Police saw a woman, later identified as Ms Whichello, upset and found Sylvia nearby and apparently affected by alcohol. The court heard Sylvia had allegedly threatened to kill a man who witnessed the alleged incident if he reported it to police. It is believed the witness, a business consultant, has told police he saw Sylvia appear to kick Ms Whichello. The case was listed yesterday for a police application to have Sylvia put on an intervention order. After being adjourned for him to get legal advice, the case was recalled and Legal Aid lawyer Leah Billeam announced that "the parties" — Sylvia and Ms Whichello — had reconciled. The prosecutor, Senior Constable Viola Nadj, said the witness to the incident was considering applying for an order against Sylvia as Sylvia had allegedly threatened to kill him if he "went to the police" about the matter. Senior Constable Nadj told magistrate Jeanette Maughan the witness asked her to mention that issue in court. Ms Billeam later told The Age the threat allegation had been raised without prior notice to Sylvia and it had "not been an issue before the court". Ms Maughan put Sylvia on a 12-month order with conditions that he not assault, harass, threaten or intimidate Ms Whichello. Ms Maughan noted that while Sylvia consented to the order, he did not admit any of the allegations and she would not consider whether a threat had been made. She warned him that until February next year he was not to breach the order but told him that "I'm sure that you are aware of that yourself." Speaking outside court, Sylvia told The Age there had been "a bit of an argument … and that's why it's turned out this way". Sylvia said: "It was just an argument between us (he and Ms Whichello) two and (the witness) got involved. That's all it is. "He said something and I said something back to him and he said I threatened him. That's the end of story." The Melbourne Football Club fined Sylvia $2000 and in a statement issued last night said he would undergo an alcohol-awareness program. "The club is disappointed that Colin did not advise us of the matter and very disappointed that he has put the good name of himself and the club at risk," the statement said. |
