Police charged Emery under the stunt driving provisions of the Highway Traffic Act. The Ontario law allows police to impound a vehicle if they catch it going 50 km/h or more over the posted speed limit. Police did not have information on how fast they clocked the vehicle. Police seized the Hummer and Emery's driver's licence for seven days.
